Urging a Veto for Concealed Carry Gun Laws

Sen. Lautenberg, Rep. McCarthy urge Obama to issue veto threat on gun bill.

 

Together with U.S. Sen. Frank Lautenberg, I am calling on President Barack Obama to issue a veto threat of legislation that was approved in the House Judiciary Committee that would allow gun owners to carry a concealed firearm across state lines even if they weren’t issued a permit by that state.

The legislation (H.R. 822) is expected to be considered for a full vote in the House of Representatives next week.
 In a letter to the President, both Sen. Lautenberg and I write that:

“We strongly urge you and your administration to make clear your opposition to, and issue a veto threat for H.R. 822. Passing H.R. 822 would jeopardize public safety and would be an insult to states like New Jersey and New York that purposefully have strong gun ownership laws.  In a country with almost 300 million guns, we need to be strengthening our gun safety laws, not weakening them.”

The House bill would allow anyone who is licensed to carry a concealed weapon in one state to carry a concealed weapon in almost every other state, even if the individual would be ineligible for a permit in the state in which he or she is carrying.   

The text of the letter follows:

Dear Mr. President:

We are writing to express our concern on a critical gun issue and to seek your leadership to protect the American people.

Like you, we share the desire to stop senseless gun violence in this country.  That is why we are particularly concerned with the recent effort to increase the accessibility and mobility of guns. A dangerous measure proposed in the House of Representatives would allow gun owners to carry concealed firearms across state lines. Passage of such a law would start a race to the bottom on gun safety with each state forced to follow another state’s laws on gun ownership.

In our states, we work hard to keep guns out of the hands of people who have no business having them. In New Jersey and New York, law enforcement is directly involved in the concealed carry permit process and has discretion to approve or deny a permit if it would jeopardize public safety. Also, individuals in our states under the age of 21 are prohibited from obtaining a concealed carry permit for a handgun, and both states do not recognize out-of-state concealed carry permits.

New Jersey and New York are not alone among the states in adopting gun laws tailored to the needs of their citizens.  However, H.R. 822 would override careful legal decisions made by our states and others by enabling visitors to ignore those laws as long as they come armed with a concealed carry permit from some other state.  New Jersey and New York, along with every other state, would effectively be forced to accept the weakest standards in the nation.

It is particularly surprising for Congressional Republicans to be pushing a measure that directly goes against their deep-rooted support for states’ rights. Indeed, under H.R. 822, state gun safety laws would be rendered moot. In a recent poll, almost three-quarters of voters opposed Washington’s interference with states’ rights to establish their own standards for issuing concealed carry permits.

We strongly urge you and your Administration to make clear your opposition to, and issue a veto threat for, H.R. 822.  Passing H.R. 822 would jeopardize public safety and would be an insult to states like New Jersey and New York that purposefully have strong gun ownership laws.

In a country with almost 300 million guns, we need to be strengthening our gun safety laws, not weakening them. We look forward to your Administration’s support in defeating this harmful legislation.

Perhaps Ms. McCarthy would like to comment on why New York has spent over $40 million of our money over the past 10 years on a ballistic imaging scheme that was to be the end of crime as we know it and which hasn't resulted in the conviction of anyone for anything. It is impossible to take her positions seriously as she continues to put forth ideals that are in complete and total conflict with reality. Sadly, her new friend Senator Gillibrand is not much better. If one wants to know Ms. Gillibrand's position on something, they have a better chance of finding out what it is by calling Senator Schumer's office.

Liberals want the law abiding citizens of America to be murdered and raped, rather then to defend their God given right to life. I have my conceal carry permit, and I expect Obama to veto this legislation. However he isn't stupid, and knows their are 80 plus million gun owners in America, and many are women and democrats who have their conceal carry permit. And I guarantee you they want to defend themselves from a failed justice system, and an administration that has armed the most deadly drug cartels on the face earth "fast & furious".

Then why is it the states with the tightest gun control laws have the highest crime rates? I have a carry permit in TN that most other states honor, but when I go to visit relatives in MD I have to un-holster, unload and store the gun and its ammo in 2 different locked sections of the car....Its BS don't worry about those carrying legally and start taking care of criminals.

Sheriff Chuck Wright opened his news conference by saying, "Our form of justice is not making it."

He said, "Carry a concealed weapon. That'll fix it."

Wright said Lance had been charged numerous times with crimes against women, and other crimes such as resisting arrest and escape. Wright said Lance had been on probation for a federal gun charge.

He referred to Lance repeatedly as an "animal," and expressed his disgust about Lance's long record and the attack.
Wright said Lance has had more than 20 charges dating back to 1983.

As long as we are prohibiting interstate recognition of a licensed activity, can we also prohibit interstate recognition of drivers licenses too? After all, there are a lot of bad drivers out there, killing many people, and many of them probably skate through the licensing process in states with weaker licensing requirements. Perhaps it would be best to require drivers to acquire non-resident endorsements from any state they plan to drive through. After all, it is for the children.

I signed up just so I could say how stupid it is to think passing a law regarding concealed weapons will fix anything. I would like for those who are for this type of ignorant law to please tell me how many convicted felons carry concealed weapons vs law abiding citizens? I also would like for those same people to tell me how passing all the other gun laws has reduced the number of gun related crimes committed by criminals?

Has Congresswoman McCarthy ever taken a vacation in Florida or gone skiing in Vermont? How about a trip to Pennsylvania or down to the beach in Delaware? If she has, I wonder if she felt particularly threatened and ill at ease. In each of those states, law abiding citizens who pass a background check and have requisite training can carry a concealed firearm (other than Vermont, which does not require training or a permit to carry a firearm). Why are the citizens of New York and New Jersey any less deserving of that right? Why should citizens of other states who obtain concealed carry licences forced to leave their right to defend themselves at the state border. McCarthy and Lautneberg -- stop the hysteria and stop your lies. You are on the losing side of this issue. Either stand on the side of freedom and honor the Constitution you took an oath to uphold or leave public office. Both of you are an embarassment.

Ohio Attorney General Mike DeWine (R) has released the concealed handgun license (CHL) statistics for the third quarter of 2011. At the end of September, we set another all-time record of approximately 253,113 Ohio residents licensed to carry concealed firearms. The total of persons with Ohio concealed handgun licenses has topped the quarter of a million mark for the first time.

Ohio is getting better all the time, with their enhancements of the Ohio state conceal carry law.

On December 7, 1993, Rep. Carolyn McCarthy's husband, Dennis, was killed and her son, Kevin, severely injured, on a Long Island Rail Road commuter train at the Merillon Avenue station, when a mass murderer, Colin Ferguson, opened fire on random unarmed passengers. Ferguson killed six and wounded 19 others. McCarthy responded to the crime by launching a campaign for additional gun control that eventually propelled her to Congress in 1996 on the Democratic ticket.

While I feel sorry for her loss, I have to wonder if this tragidy could have been averted had some of the passengers on that train been armed? Instead, Rep. Carolyn McCarthy appears dedicated to the falicy that preventing citizens from exercising their right of self defense somehow makes them safer.

“ . . . THE RIGHT OF THE PEOPLE TO KEEP AND BEAR ARMS, SHALL NOT BE INFRINGED”
“shall not be infringed” does not give (or reserve to) the Federal Government OR the States the power to infringe; instead it specifically DENIES the Federal Government AND the States that power. “THE POWERS NOT DELEGATED TO THE UNITED STATES BY THE CONSTITUTION, NOR PROHIBITED BY IT TO THE STATES, ARE RESERVED TO THE STATES RESPECTIVELY, OR TO THE PEOPLE.” The RIGHT (and the power) to “keep and bear arms” belongs to (and is reserved to) the people.

This is not an issue of States' rights but rather is an issue of the Federal Government fulfilling its obligations to prevent States from denying citizens' US Constitutional rights!

I strongly urge Rep. Carolyn McCarthy to fulfill her obligations under the oath of office she took!

To all members of the U.S. 112th Congress:
I am writing this email to encourage you to cosponsor H.R.822, National Right-to-Carry Reciprocity Act of 2011 and vote affirmatively for this bill when it comes up for a vote. There are clear and undeniable U.S. Constitutional provisions that support this measure. Recent Supreme Court decisions have affirmed individual rights under Amendment II of the U.S. Constitution. In addition, this bill is required for the Federal Government to fulfill its constitutional obligation, on this matter, under Section 5, Amendment XIV.

As of the date of this email there are 246 sponsors and cosponsors of H.R. 822 ,which represents 56.6% of the votes in the U.S. House of Representatives. It is interesting to note that there are 193 Democratic and 242 Republican Representatives in the U.S. House of Representatives; yet only 34 (17.6%) of the Democratic Representatives are cosponsors of H.R. 822 while 212 (87.6%) of the Republican Representatives are sponsors/cosponsors. I thought that in the U.S.A. we elect candidates that will respect the US Constitution and represent their constituents rather than a political party. I urge all Representatives to fulfill their obligations under the oath of office they took under Article VI of the U.S. Constitution as regards Amendment II of the U.S. Constitution and support H.R. 822 rather than vote along party lines as they do in governments with “strong party discipline”.

About a month ago I went on vacation to South Carolina. My two concealed carry permits do not include S.C. The law there says I had to keep it in the glove box or console which I did. While on a shopping trip someone broke into my car and stole my firearm. Now I ask you, which is more safe for the residence in S.C, An out of state conceal carry holder carrying his firearm or a resident thief.

The Second Amendment is not a state right. It is a constituti­onally-pro­tected right just like your freedom of speech, religion, right to due process, protection from illegal search and seizure, etc. In fact, the Second Amendment is a carryover from the 1689 colonial Bill of Rights where colonists had the right to keep and bear arms for self defense.

You shouldn't be alarmed about firearms. You should be alarmed that the government is eroding your constituti­onally-pro­tected right by restrictin­g your right and making you buy a permit to exercise your right.

In this modern Informatio­n Age where Bullying abounds, what's next: the government restrictin­g our First Amendment right to free speech? You may scoff at that but consider Americans scoffed at the notion of gun laws prior to 1934.

It's time to turn back the anti gun laws. All honest citizens should be allowed to own and carry firearms unrestricted. Going to New York city, strap on a 45 and have a good time. Next Tea Party march in Washington 10 million armed citizens as our founders intended.
