Mineola Village Board Notebook: July 10

Other news from the July 10 village board meeting.

The Mineola Village Board of Trustees held a meeting on Wednesday, July 10. Here are some of the things you may have missed.

Notice of Claim Act

  • The board adopted its local version of the New York State Uniform Notice of Claim Act.
  • Village attorney John Spellman explained that a notice of claim is something which must be filed upon the village prior to suing the entity in the case of personal injury or property damage within 90 days of the incident.
  • In December 2012 New York Governor Andrew Cuomo signed into law this new measure which authorizes the state “to be the one sent a notice of claim within a certain number of days,” Spellman said.
  • The law went into effect on June 15, 2013 and requires that a person filing with the state pay a $250 fee, with the village receiving half of that fee any time a claim is filed.
  • “If we don’t opt in, we can still file with the state, but we won’t get the fee,” Spellman said, noting it must be done by July 15.
  • The traditional way of serving the village – that of serving notice to the village clerk – is also available.
  • According to Spellman, the village receives about three or four notices of claims per month on average.

Truck Purchase

  • The village will purchase one new 2014 International Workstar 7300 4x2 Chassis with gallon dump body and Wausau Plow from the Genessee County Contract at a cost of $144,900 from the delivering dealer of Syosset Trucks.
  • According to superintendent of public works Tom Rini, the village truck No. 15 is a 1989 model year that is used for asphalt, snow and tree removal and salt spreading and “at 24 years of age, the truck finally died this week.”
  • Rini stated that the cab had come off its chassis mount, collapsing down onto the chassis and combined with rot, rendered the transmission and clutch useless.
  • “When something that severe happens to a vehicle of that age, there’s not much that I can do about it,” Rini said. “We can’t rebuild the truck, unfortunately.”
  • A replacement for the truck had originally been planned for the future.
  • The cost for the truck will be paid out of the DPW equipment line in the budget with the balance being covered by a revenue increase from the building department for permit fees according to mayor Scott Strauss.

  • Mineola AARP Chapter 4202 will make use of the community center for their 2013-14 general membership meetings and a general purpose room for their board of directors meeting on the following Wednesday dates from 8:30 a.m. to 1 p.m.: September 18; September 25; October 23; November 20; Jan. 22; 2014; Feb. 26, 2014; March 26, 2014; April 23, 2014; May 28, 2014; June 25, 2014.
  • Mineola AARP Chapter 4202 will male use of a general purpose room for their arts and crafts committee on the following Tuesdays from 9:30 a.m. to 12 p.m.: September 17; October 1; October 15; November 19; December 3; December 10; December 17; Jan. 7, 2014; Jan. 21, 2014; Feb. 4, 2014; Feb. 18, 2014; March 4, 2014; April 1, 2014; April 15, 2014; May 6, 2014; May 20, 2014; June 3, 2014; June 17, 2014.
  • The board approved a request from the Mineola Fire Department softball team to utilize a section of Wilson Park for its volleyball tournament fundraiser and a barbecue afterward from 9 a.m. to 4 p.m. on Saturday, July 20.

Other Board News

  • The board authorized the installation of a handicapped reserved parking space in front of 52 Liberty Ave.
  • Anthony Marmo was approved as a new member Company No. 2 of the Mineola Fire Department.
  • Budget transfers for the library and pool funds for the 2012-13 fiscal year was authorized in the following amounts: library: $35,257.05; pool: $39,873.64.
  • The board authorized the advertisement for the position of a village auditor after a member of the village treasury department left.
  • Salary increases for the appointed managerial and administrative staff members was approved.
  • July 31 is the last day for early bird fall registration for the Mineola Athletic Association soccer league. After July 31 a late fee will be charged.

The next meeting of the Mineola Village Board will be on Wednesday, August 7 at 6:30 p.m. at the village hall.
